Terms of Service

1. Service Description

fits.net provides GPU-accelerated virtual desktop services on a subscription basis. Our service uses spot/interruptible GPU resources, which means your session may be interrupted at any time without warning. By using fits.net, you agree to these terms.

2. Eligibility

You must be at least 18 years old to use fits.net. Each account is for individual use only - you may not share your account credentials with others or allow multiple individuals to access a single account.

3. Subscription Terms

Subscriptions are billed monthly at $10-$40/month depending on your chosen tier. Your subscription includes persistent storage and unmetered usage, subject to the Fair Use Policy below. You may change or cancel your subscription at any time.

Plan changes: Upgrades and downgrades take effect immediately. Upgrades are prorated for the remainder of your billing cycle. Downgrades result in account credit for unused time - no cash refunds are provided. Credits apply automatically to future billing.

4. Fair Use Policy

fits.net offers unlimited usage for normal, interactive workloads. To ensure fair access for all users, the following restrictions apply:

  • No sustained maximum load: You may not run workloads that continuously maximize CPU or GPU utilization for extended periods. Brief periods of high utilization for legitimate tasks (image generation, training, inference) are expected; sustained 24/7 maximum load is not permitted.
  • Interactive use priority: This service is designed for interactive desktop use, development, and learning - not for running unattended batch jobs around the clock.
  • Resource consideration: Please stop your desktop when not actively using it to free resources for other users.
  • Queuing and session limits: During peak demand, new sessions may be queued until resources are available. We reserve the right to limit session length (minimum 1 hour guaranteed) to ensure fair access for all subscribers.
  • Sole discretion: fits.net reserves the right to throttle, suspend, or terminate accounts that abuse the fair use policy, at our sole discretion and without prior notice.

Examples of acceptable use: running LLM inference (Ollama, llama.cpp), training models, generating images (Stable Diffusion), speech recognition (Whisper), development work, Jupyter notebooks, learning and experimentation.

Examples of abuse: cryptocurrency mining, running 24/7 batch processing jobs, reselling compute time, leaving intensive workloads running unattended for days.

5. Acceptable Use

You agree to use fits.net only for lawful purposes and in compliance with all applicable laws. You must maintain strong passwords and keep your login credentials secure and confidential.

6. Prohibited Activities

The following activities are strictly prohibited:

  • Cryptocurrency mining of any kind
  • Storing, distributing, or transmitting malware or malicious code
  • Hosting unlawful, harmful, threatening, defamatory, or obscene content
  • Content promoting unlawful violence or discrimination
  • Military purposes, including development, production, testing, or use of weapons
  • Distributed denial-of-service attacks or other network abuse
  • Sending spam or bulk email (email ports 25, 465, 587 are blocked)
  • Reselling, sharing, or providing unauthorized access to third parties
  • Reverse-engineering, decompiling, or attempting to extract source code
  • Any activity that violates applicable laws or sanctions

7. Geographic Restrictions

Our service is not available in the following regions: Russia, Belarus, Cuba, Iran, North Korea, Syria, Crimea, Donetsk, and Luhansk regions. You may not use the service if you are located in these regions or are subject to applicable sanctions.

8. Service Interruptions

Our service uses spot GPUs which may be interrupted at any time without warning. The service is provided "as is" with no guarantee of uninterrupted operation. We are not liable for any data loss or work interruption due to spot instance preemption, third-party service failures, or internet bandwidth limitations. Save your work frequently.

9. Data and Backups

Your data is stored on persistent storage associated with your subscription tier. You are responsible for maintaining your own backups and disaster recovery. We recommend performing regular independent backups of any important data. Deleted data may be recoverable for up to 96 hours, after which it is permanently removed.

10. Software Updates

You are responsible for updating any third-party software you install. We recommend testing updates in a non-production environment before applying them to critical workloads.

11. Termination

You may cancel your subscription at any time through the billing portal. Upon cancellation, your desktop and all data will be permanently deleted immediately. This action cannot be undone. Please backup any important data before cancelling. We reserve the right to immediately terminate accounts that violate these terms.

12. Limitation of Liability

fits.net is provided "as is" without warranties of any kind. Our total liability is limited to 20% of the service fees you have paid in the relevant period. We are not liable for any indirect, incidental, or consequential damages, including data loss from user-caused corruption, arising from your use of the service.

13. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
